To whom it may concern:

I am writing to request a record of all arrests from the Los Angeles Police Department for the years 2005 to present, or as many years as are available. Specifically, I am requesting the following information:

  • Data Observation (Rows): Arrest Charge
  • Time Frame: 1/1/2005-Present
  • Data Fields: Arrestee Name, Race, Ethnicity, Gender, Age, and Address; Offense and Charge Description, Charge Level (Misdemeanor/Felony Class), Time and Date of Arrest, Location of Arrest (Address and/or Geographic Coordinates), Police Division, Police Beat 

I am requesting these records in digital format as csv or excel files transferred via email or some other internet platform transfer, rather than as DVD discs.

These records have been released to the public for more recent years through the Los Angeles Data Portal for your city and police department (https://data.lacity.org/A-Safe-City/Arrest-Data-from-2010-to-Present/yru6-6re4).

Please let me know if there is any way that I can help to clarify or complete the request. I understand that completing this request may require payment to cover administrative or operational costs.

We reviewed your request for, “To whom it may concern:

 

I am writing to request a record of all arrests from the Los Angeles Police Department for the years 2005 to present, or as many years as are available. Specifically, I am requesting the following information:

  • Data Fields: Arrestee Name, Race, Ethnicity, Gender, Age, and Address; Offense and Charge Description, Charge Level (Misdemeanor/Felony Class), Time and Date of Arrest, Location of Arrest (Address and/or Geographic Coordinates), Police Division, Police Beat”

 

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 6254(b); 6254(c); 6254(f); 6254(k); and 6255.

 

Except for arrestees' addresses, the responsive documents have been provided to you.

 

We assert the privilege under Section 6254(k) and Evidence Code Section 1040 in omitting arrestees' addresses from the records. Section 6254(k) exempts records that are exempt from disclosure under federal or state law, including but not limited to provision of the Evidence Code relating to privilege. Evidence Code Section 1040 declares and official information privilege for information acquired in confidence by a public agency when the public interest in disclosing the information is outweighed by the public interest in keeping the information confidential. The Department has a strong interest in maintaining the confidentially of these portions as disclosure of this information to the public could potentially endanger the Department’s operation, the safety of its officers and the public. Therefore, I am providing you with a redacted copy of the requested records.
