The Respiratory Care Board of California (Board) is a state licensing agency with regulatory jurisdiction over respiratory care practitioners. The Board is responsible for enforcement of the Respiratory Care Practice Act (Business and Professions Code Section 3700 et seq.) As an agency tasked with investigating its applicants and licensees, the Board is authorized to receive, from local or state agencies, certified records of all arrests and convictions, certified records regarding probation, and any and all other related documentation needed to complete an applicant or licensee investigation (Business and Professions Code section 144.5).
The information requested is required as part of a formal Board investigation regarding the qualifications of a licensee or applicant for licensure to maintain a license. The Board shall maintain in confidence any personal information received in accordance with the Information Practices Act (Civil Code Section 1798 et seq.) and all other applicable law.
