On May 22, 2018, Paulita Elliott, General Manager, Downtown Santa Monica Ambassador Program, wrote "Our ambassadors do not carry any weapons of any form; to include pepper spray or handcuffs. We are a Hospitality and Maintenance Program here in Santa Monica. We do provide safety services at some accounts but this also does not include the carrying of any weapons.  Below are two links: The top one is information on our program here in Santa Monica and the secondary one is our company itself which contracts with Downtown Santa Monica Inc.”

The Venice Beach Business Improvement District safety team carry handcuffs and pepper spray. They cannot be compared to the Downtown Santa Monica Ambassador program. 

The Venice Beach BID website states that their Safe Teams provide “support for compliance” with “Los Angeles’ policies regarding homeless encampments and “support for compliance” with Venice Beach Boardwalk regulations.

Please provide documentation of the legal definition of the role of the Venice Beach BID “Safe Team" to support "compliance” with "Los Angeles’ policies regarding homeless encampments.”

It is my understanding that on 01/08/19, Incident #0927 was reported to LAPD Officers Suzuki #41510 and Hernandez #43132, and Sgt Probst #14620. The complaint was that VBBID officers were aggressively engaging with homeless people to wake them up at 6am, move their belongings, and more. 

That is unlawful.

Please provide documentation of the legal definition of the role of the Venice Beach BID “Safe Team" that does not replace a city service, but that is a “special benefit” that is not a general benefit or a benefit to the general public, when 28% of the property in the VBBID is public property deeded by Abbot Kinney as a free speech zone in perpetuity.

Prop 218 says that a Business Improvement District cannot replace city services. 

BIDs must provide a “special benefit” that is not a general benefit or a benefit to the general public. The Venice Beach BID Clean Team removes the city issued plastic trash bags in the public receptacles and replaces them. That is a city service. That is a violation of Prop 218.

Please provide documentation of the legal definition of the role of the Venice Beach Clean Team services that does not replace a city service, that is a “special benefit” that is not a general benefit or a benefit to the general public.
