Under the California Public Records Act (Government Code §§ 6250 et seq.) and Article I, Section 3 of the California Constitution, I am requesting an opportunity to obtain electronic copies of the following public records:
- Any all information or written communications (including letters and/or emails) from Miguel Guillen to the City of Los Angeles and/or the Department of Public Works (Bureau of Street Services) complaining of race discrimination and harassment occurring in the City’s Resurfacing Reconstruction Division located at 2484 E. Olympic Boulevard in Los Angeles (known to many as “Plant I”) [From 2015-2017]
- Any all written communications from Miguel Guillen to the City of Los Angeles and/or the Department of Public Works (Bureau of Street Services) complaining of race discrimination and harassment occurring in the City’s Resurfacing Reconstruction Division located at 2484 E. Olympic Boulevard in Los Angeles (known to many as “Plant I”) that reference racist and/or offensive comments and conduct by City employee Edward Singer [From 2015-2017]
- Any and all written communications (including e-mails and/or letters) sent by or received by Edward Singer between December 1, 2015 – December 7, 2015 regarding Devindra Somadhi.
- Any and all information or documents regarding the demographics of the Department of Public Works (Bureau of Street Services) Resurfacing Reconstruction Division located at 2484 E. Olympic Boulevard in Los Angeles (known to many as “Plant I”) [From 2015-2017] Specifically, the total number of employees who are African American.
Please note that the Public Records Act allows a member of the public to request records by describing their content, rather than asking for specific documents by name; an agency that receives such a request must “search for records based on criteria set forth in the search request.” This request applies to all records in your agency’s possession, including documents created by a member of another government agency or a member of the public. If specific portions of any documents are exempt from disclosure, please provide the non-exempt portions. (Government Code § 6253(a).) Please provide entire documents, even if only parts of them are responsive to this request. If you maintain records or data in electronic format, please provide them in that same format (locked versions are acceptable) to avoid copying costs. (Government Code § 6253.9.) If you are unable to reproduce electronic records in electronic form, please provide a reason for doing so.
If there are any fees for searching and copying these records, please inform me if the cost will exceed $50.00.
The California Public Records Act requires a response within ten (10) business days, either by providing all the requested records or by providing a written response setting forth the legal authority for withholding or redacting any document and stating when the documents will be made available. (Government Code §§ 6253(c), 6255.) If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records.
